Please read these Terms of Service ("Terms") carefully before using SciEval (www.sci-eval.com) ("the Service"), operated from Luxembourg ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
SciEval is a web-based scientific data analysis platform. The Service provides:

You must be at least 16 years old and capable of entering into a legally binding agreement to use the Service. By registering, you represent that you meet these requirements.
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately if you suspect unauthorized access to your account. We are not liable for losses resulting from unauthorized use of your account.
You agree to provide accurate and complete registration information (first name, last name, email address) and to keep it up to date. We may suspend accounts with demonstrably false information.

If you submit data that contains personal data of third parties (such as research participants, patients, employees, or other identifiable individuals) to the Service for computation, you act as an independent data controller for that data, and we act as a data processor on your behalf, processing it solely to provide the requested Service.

A formal Data Processing Agreement (DPA) in accordance with Art. 28 GDPR is available upon request for users who submit personal data of third parties to the Service. Contact us at the details in Section 17 to request one.
We strongly recommend avoiding the submission of directly identifiable personal data where it is not strictly necessary for your scientific analysis. We assume no liability for your compliance with applicable data protection laws in connection with data you submit to the Service.
The Service, its design, underlying software, algorithms, and documentation are owned by us and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to our intellectual property beyond what is necessary to use the Service.
You retain ownership of all data, function definitions, models, and other content you create or upload to the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to process, store, and display Your Content solely for the purpose of providing the Service to you.
When you associate a publication reference (DOI, title, authors) with a function, model, or other item on the Service, you represent that you have the right to use this information and that you attribute it accurately. We do not claim ownership over referenced publications.
By linking a publication to any item, you acknowledge and agree that:
This provision exists to maintain the integrity and usefulness of the shared scientific knowledge base. If you do not wish an item to persist after account deletion, remove the publication association before deleting your account.
The Service may offer both free and paid subscription plans. Free-tier features and limitations are described on the Service. Paid subscriptions unlock additional capabilities.
All payments are processed by Stripe, Inc. By purchasing a subscription, you also agree to Stripe's Terms of Service. We do not store your credit card or bank details — these are handled entirely by Stripe.
A user may purchase a subscription on behalf of another registered user. The purchasing user is responsible for payment. The recipient user receives the subscription benefits.
Paid subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected). Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then. We do not offer prorated refunds for partial billing periods.
We may change subscription prices with at least 30 days' advance notice. Price changes take effect at the start of your next billing cycle after the notice period.
When you submit a computation (function evaluation, curve fit, ODE solve), it is processed asynchronously. We make reasonable efforts to process tasks promptly, but do not guarantee specific execution times. Tasks may fail due to mathematical errors, invalid input, or system constraints. Submitted data is subject to a maximum size limit; requests that exceed this limit are rejected before processing.
Computation results are stored for a limited period determined by your subscription plan. You will receive an email reminder before results are scheduled for deletion. You may mark specific results to be retained indefinitely. Stored results are encrypted at rest at the application level; see our Privacy Policy for details on how we protect your data.
While we take reasonable measures to safeguard stored data, we do not guarantee against data loss. You are responsible for maintaining your own backups of important data and results.
You may request deletion of your account at any time. Upon deletion:
We may also suspend or terminate your account if you violate these Terms or engage in conduct that harms the Service or other users.
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Scientific computations are performed using established numerical methods, but we make no guarantees regarding the accuracy, completeness, or suitability of computation results for any particular application. You are solely responsible for validating results before relying on them in publications, engineering decisions, or other contexts.
To the maximum extent permitted by Luxembourg law and applicable EU regulations, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. This includes, without limitation, damages for loss of data, loss of profits, business interruption, or reliance on computation results. Our total aggregate liability for any claims arising under these Terms shall not exceed the total amount you have paid to us in the twelve (12) months preceding the claim. Nothing in these Terms excludes or limits liability for fraud, gross negligence, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with the General Data Protection Regulation (GDPR). The Privacy Policy is incorporated by reference into these Terms. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. The "Last Updated" date at the top indicates the most recent revision. Continued use of the Service after the updated Terms take effect constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service and may request account deletion.
These Terms are governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Luxembourg City, Luxembourg.
If you are a consumer resident in the European Union, you retain the benefit of any mandatory provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU consumer protection legislation, including Directive 2011/83/EU on consumer rights.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely achieves the original intent.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the Service and supersede any prior agreements or understandings.
We shall not be liable for any delay or failure to perform our obligations under these Terms due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, government actions, prolonged internet outages, or failures of third-party infrastructure providers. In such events, we will make commercially reasonable efforts to notify you and to resume performance as soon as practicable.

Messages you send us — whether through our contact form or by email — are processed solely to handle your inquiry and are retained in accordance with our Privacy Policy. Contact-form messages are automatically deleted 90 days after submission, unless a longer retention period is necessary to resolve an ongoing matter.
